Terms of Service

Welcome to NextGen RN. These Terms of Service (“Terms”) govern your access to and use of the NextGen RN website, mobile applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

NextGen RN provides educational content, practice questions, case studies, flashcards, cram sheets, and study-planning tools designed to help nursing students prepare for the NCLEX-RN examination. All content is for educational and informational purposes only.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent that you meet this requirement.

3. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

Some features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis. All payments are processed securely through our payment provider. Prices are subject to change with notice.

5. Intellectual Property

All content, materials, and features available through the Service — including questions, case studies, cram sheets, text, graphics, and software — are owned by NextGen RN or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. Prohibited Conduct

You agree not to: (a) use the Service for any illegal purpose; (b) share your account credentials with others; (c) scrape, crawl, or otherwise extract content from the Service; (d) attempt to bypass security measures; or (e) upload harmful code or content.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. NEXTGEN RN DOES NOT GUARANTEE THAT YOU WILL PASS THE NCLEX EXAMINATION. CONTENT IS FOR EDUCATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR NURSING ADVICE.

You expressly acknowledge and agree that: (a) the Service is strictly an educational study aid and does not guarantee, promise, or ensure that you will pass the NCLEX-RN examination or any other licensing or certification examination; (b) the content, including practice questions, rationales, case studies, cram sheets, and study plans, is provided for general educational and informational purposes only and does not constitute medical, nursing, diagnostic, or treatment advice, nor formal clinical training, supervision, or continuing-education credit; and (c) results on practice items are not predictive of, and should not be relied upon as an indicator of, performance on the actual NCLEX-RN examination or clinical competence.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGEN RN, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS DISCLAIM ALL LIABILITY FOR ANY EXAMINATION OUTCOME, INCLUDING BUT NOT LIMITED TO EXAM FAILURE, DELAYED LICENSURE, LOST INCOME, LOST OPPORTUNITY, RETAKE FEES, TUITION, OR ANY OTHER DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR INDIVIDUAL TESTING RESULTS, PREPARATION DECISIONS, OR USE OF THE SERVICE. YOU ASSUME FULL AND SOLE RESPONSIBILITY FOR YOUR EXAM PREPARATION AND OUTCOMES.

8. No Affiliation with NCSBN; Trademarks

NextGen RN is an independent educational service. We are not endorsed by, affiliated with, sponsored by, licensed by, or otherwise connected to the National Council of State Boards of Nursing, Inc. (NCSBN®), any state board of nursing, or any official test-preparation program. NCLEX®, NCLEX-RN®, NCLEX-PN®, and NGN® are registered trademarks of the NCSBN. All other trademarks are the property of their respective owners. Any references to these marks are for identification and descriptive purposes only and do not imply any relationship, endorsement, or approval. Practice items provided through the Service are original works and are not, and do not purport to be, actual questions from the NCLEX examination. Any resemblance to real examination items is coincidental.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTGEN RN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms that by their nature should survive termination will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance.
